This policy governs how personal data is collected, used, and processed by Ethical Energetics and Kat Michaels, and explains how personal data is used by third parties associated with Ethical Energetics and Kat Michaels.

Use of this website and/or resources or services provided by Ethical Energetics and Kat Michaels constitutes agreement with this Privacy Policy, as well as with the Terms and Conditions and the Informed Consent Agreement, where applicable.

Definitions

For purposes of this privacy policy, the term “visitors” refers to those persons accessing this website, whether for browsing, use of available resources, review of the terms and conditions, or any other purpose. The term “member” refers to purchasers of our services and subscribers of Amplify: The Membership, who may or may not also be visitors.

Data Collected, Used, and Processed

We collect, use, and process the personal data of visitors and members such as name, email address, and other identifying details with the consent of the visitor or member and/or for the fulfillment of any request that is made of and accepted by Ethical Energetics and Kat Michaels. We may also use the personal data of visitors and members as necessary to fulfill legitimate interests of Ethical Energetics and Kat Michaels, providing that those interests are not outweighed by our visitors’ and members’ interests, rights, and freedoms.

Joining our mailing list; requesting information regarding resources; booking a session; or otherwise submitting a query through our Web site, social media accounts, email, or any other communication channel constitutes consent. We make every attempt to limit the information gathered at each step to ensure the maximum amount of privacy for each of our visitors and members.

We use cookies for security, authentication, preferences, and performance monitoring regarding referral source, ad campaigns, promotions, and related purposes. Visitors generally may access information regarding blocking and/or deleting cookies through the help sections of their Internet browsers.

We use analytics software for the purposes of tracking Web site traffic and performance, source data, and promotions. Through our analytics software, we obtain personal data such as city, state or territory, country, and browser used. We do not access demographics data through our analytics software.

When visitors or members use our resources, we collect information that is necessary to communicate with that visitor or member and to provide the resources that are utilized. Information collected may include the visitor or member’s name, email address, mailing address, telephone number, payment information, date of birth, place of birth, time of birth, and related necessary information.

Depending on method of payment, payment information may by default include a shipping address, even if that information is not strictly necessary for use of the resource(s). Purpose, goals, and expectations of our visitors and members are also gathered for the purpose of resource use, when applicable, and in some cases may include medical information that is considered sensitive data.

Retention and Sharing of Data

Data gathered is never sold or shared, except with third parties upon whom we rely to process the data for discrete and limited purposes. Third parties relied upon to process information for Web site content management, hosting, booking, domain and email, email marketing, email and instant communication, cookies, analytics, and payment processing include WordPress, WPX Hosting, Airtable, Book Like A Boss, Hover, Ontraport, Voxer, Zoom, Google Analytics, and Stripe, respectively.

Those visitors and/or members who contact Ethical Energetics or Kat Michaels through any of our social media accounts also consent to the sharing of their data with the third-party social media company and its subsidiaries.

If required for legal, tax, or other similar purposes, data may be released to courts, to necessary federal and state agencies, and/or to federal, state, and/or local tax authorities including the United States Internal Revenue Service and the Wyoming Department of Revenue. We will make every effort to minimize the data disclosed and to redact, encrypt, or otherwise mask identifying data if possible in these instances.

We do not retain payment data such as credit card numbers, expiration dates, and card security or verification codes, though these details may be retained by the payment processor depending on the payment processing method used and permissions granted separately to that processor. Those visitors and/or members who register for paid programs and services agree that their payment data may be retained by Ontraport, in accordance with Ontraport’s encryption and data retention policies.

Data provided to us through this website or through any other method will remain confidential except as detailed in the paragraph above and except as otherwise required by law. Data will be released in the case that a visitor or member indicates an intention to harm him/herself or others; we are mandatory reporters and are required to notify the proper authorities if any such indication exists.

Data pertaining to visitor or member use of resources, including sensitive data, is retained for three (3) years following the cessation of the visitor or member relationship; data required for legal, tax, and similar purposes is retained for seven (7) years following the cessation of the visitor or member relationship. We generally retain all client reports and other reports and communications for the duration of the visitor or member relationship, unless the visitor or member requests otherwise, in writing.

Visitor and member queries, reports, and other data pertaining to utilized resources, including sensitive data, are stored locally, with secure Cloud-based backups made through Carbonite. Email communications are excepted from this and are stored on the Ethical Energetics and Kat Michaels email servers, which are owned by Hover; social media messages are retained by the third-party social media company and on their proprietary applications, which are used by Ethical Energetics and Kat Michaels to access and respond to such messages. Zoom coaching and all other video sessions are stored locally and on Vimeo. Amplify Zoom coaching sessions are recorded and made available to all Amplify group members after the completion of the call. Members attending Amplify Zoom coaching sessions agree to have their questions addressed in a group format and to have the answers to such questions recorded for later viewing by Amplify members. 1:1 video sessions are recorded by request and, if recorded, will be made available for download by the member attending the video session.

We may contract occasionally with Web designers and IT specialists who may obtain access as required to our Web site data, registration data, email marketing lists, and other data for troubleshooting, design, and/or data infrastructure purposes. Contractors never have access to payment data or sensitive data.

Individual Rights Pertaining to Stored Data

Should you prefer, you have the right to have your data modified, archived, and/or deleted depending on type of data and/or our legitimate use for the retention of such data. If you believe that any of the retained data is incorrect, such as name, email address, or other information, you may contact us with instructions regarding the information that you would like updated. In some limited cases, you may be required to provide corroborating paperwork before your information will be updated.

If you prefer to have your data archived and/or deleted, you may contact us using the information shown below. If a request for deletion of data is made, we will archive all data required to be retained for legal, tax, accounting, and related purposes, and we will delete all remaining data that is not required to be retained for such purposes. You will receive an email confirming the archival and/or deletion of your data.
